1. Acceptance of Terms
By accessing or using myThalamus ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We reserve the right to update these terms at any time, and continued use constitutes acceptance of any changes.
2. Description of Service
myThalamus is a cognitive wellness platform that provides audio-based neural stimulation tracks, brain training games, daily habit tracking, and educational content. The Service is designed for general wellness purposes and is not a medical device, diagnostic tool, or substitute for professional medical advice.
3. Account Registration
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account.
4. Subscription & Payments
Paid features are available through monthly subscription plans (Starter and Pro tiers) and one-time digital product purchases. Subscriptions renew automatically unless cancelled before the renewal date. All payments are processed securely through Stripe. Prices are in USD and may be updated with 30 days' notice.
5. Refund Policy
One-time digital product purchases (e.g., the Neuro-Safe™ Protocol) are covered by a 60-day money-back guarantee. If you are not satisfied, contact us within 60 days of purchase for a full refund. Subscription fees are non-refundable for the current billing period but you may cancel at any time to prevent future charges.
6. Intellectual Property
All content on the Service — including audio tracks, game designs, written content, graphics, and software — is owned by myThalamus or its licensors and is protected by copyright and intellectual property laws. Your purchase or subscription grants you a personal, non-transferable licence to use the content for your own personal, non-commercial use.
7. Acceptable Use
You agree not to: redistribute, resell, or share your account or purchased content; use the Service for any unlawful purpose; attempt to reverse-engineer, decompile, or extract source code from the Service; use automated tools to access the Service; or impersonate another person or entity.
8. Limitation of Liability
To the maximum extent permitted by law, myThalamus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases, but provisions regarding intellectual property, limitation of liability, and dispute resolution survive.
10. Governing Law
These terms are governed by the laws of British Columbia, Canada. Any disputes shall be resolved through binding arbitration in Vancouver, BC, unless otherwise required by applicable consumer protection laws.
